1. I wanted to buy one Oakley sunglass, I searched the same on TataNu app, it showed me the desired article which I decided to purchase.
2. I proceeded to buy the sunglass where I was redirected to Tatacliq luxury page where this product was actually available and sold by MODA OPTICS.
3. I placed the order for this sunglass on 31 August 2024, and the product was delivered me on 7 September
4. The total cost of the product was Rs. 11,119 after bank discount. I made the payment using 3,000 TataNu coins and rest payment went through the BOB credit card.
5. I found that the sunglass is little loose on my face and slipping away from my nose. As it was under 7 days easy return, I decided to return the product and I created its return on 9 September.
6. The return pickup was scheduled on 11 September. On 11 September around 2pm, one of the courier partner (from bluedart) came and did initial varrification of the sunglass, everything was intact and sunglass was in the returnable and new condition as I received it.
7. On 14 September, I received the mail from tatacliq care that the quality check has failed and your request for refund has been declined as we didn't received back the sunglass in good condition.
8. I registered my complaint on tatacliq customer care number for refunding my money. They asured me that our team will decide your case latest by 21 September.
9. Till 22 September, tatacliq care didn't respond anything regarding my refund request.
10. On 22 September I called National Consumer Helpline (1800114000) to seek help from them, they registered my complaint and sent mail to tatacliq care.
11. Tatacliq never called me in between while they updated on NCH portal that work in progress.
12. I was informed by NCH team that tatacliq has shared the images of sunglass which is full of scratches on the lens of sunglass.
13. Tatacliq team took full one month to finally deny refund, on 22 October 2024 they updated on NCH portal that they will not be able to refund the money because of product was damaged when it was received back by them.
14. I returned them the product in fine condition, i don't know what went wrong? If there are scratches on the lens, it might have come due to mishandling by return courier and during transit.
15. Now tatacliq is not even returning my product back to me and nore refunded my money, therefore both product and my money is stuck with them.
16. I called tatacliq care tem to get my product back, they are saying you will have to approach National Consumer Helpline to get your sunglass back, as NCH team is higher authority unless they won't say us to return the product back to you, we will not be able to ship it back to you.
So, my concern is, what should I do here in order to get my product back or get my money refunded?
Should I file offline case in district consumer forum?
Will charge back work here, since its almost 2 month since I placed this order.
