Hi All,
I applied for a credit card with HDFC from branch and they approved it with 75k limit but upon arrival I was unable to enable it or do any transaction, I visited branch they had also no ideas what's the issue. After I tweeted got a call back from them and they told since my father had defaulted on his credit card payments with them that's why their back end team disband my credit card after receiving? What can be done in this case, I have good cibil 780+ and never defaulted on any payment and no link to my father. How to get credit from HDFC now.
The card still shows in my account but shows available limit 0

what is the legal standing point here?
can debt be recovered from family members or not?
Don't get me wrong here! In most cases, the bank will win. Now, as per OP, he didn't mention if he or his dad has any relationship with HDFC. Because if that's not true, then during the account opening process, I'm sure it must be mentioned somewhere, where the bank can recover their funds through family and friends in the Term and conditions.

i agree with you
logically it makes sense to recover debt from children
because it goes without saying the child inherits the parents assets and liabilities all included

My understanding is, as OP's father is alive, he cannot be liable for his father's debt and in case of credit card, absolutely not.
Debts are the responsibility of the person who incurred them, and family members typically do not inherit the debts of their living relatives.
but if the father has defaulted and might have been written off as npa,
then the bank has legal grounds to recover the money from the child.
because bank takes on additional risk when extending credit to a defaulte/relative of defaultee because default risk increases in this case

Again, No! Both are separate individuals.
As he is not the co-owner of the credit card.
And that credit card has been issued to his father's name based on his father's credit and for personal usage, not for the OP's usage.
He is not liable for any debt related to this.

This is how HDFC works.

My Friend's Parents also did not paid Car Loan Last Few EMIs.

Those Bast**ds deducted that Unpaid Amount from my freinds Bank Account when He opend a New HDFC Bank Account.

Upon asking why they deducted, HDFC Employee told that My Freind Name was added as Nominee in Car Loan, hence they Recovered the Amount.
Clear violation, the money can't be deducted unless and until your friend was a guarantor in the car loan. Can sue the banks easily.

doesnt matter as if there is any outstanding which creates a liability it also gets inherited
No Sir. I can't repeat myself in other ways. My understanding is clear. Credit card dues cannot be thrown to the relatives until he/she is the co-owner.
Credit cards are issued for personal usage.
Similarly to this, any personal loan cannot be passed to relatives.
