Extended credit reporting complaint to RBI

Hello everybody

One of my first credit card - OneCard by SBM Bank India.
Issued - 5 Sep 2022
Closed - 8 Sep 2023
Last Credit reporting to CIBIL & Experian - May 2024

Just with above information, any stupid person will also understand that the bank is reporting my payments even after closure of card.

Bank has reported Zero DPD which is technically correct but this increased the payment history from 12 months to 21 months.

Now here's the story begins
I noticed these in May 2024, first complained to SBM nodal officer on 09 June 2024..
Did not receive any response from them. Escalated to principal nodal officer then also didn't receive any response.

Then had to complain to RBI ombudsman on June 27. On Tuesday this week I received the closure mail from RBI stating the summary of what SBM Bank responded to the complaint -

My major concern is that rbi ombudsman didn't gave me a chance to counter the bank's response. The bank has clearly hidden the card closure date, that's why last reporting in May 2024 seems justified.
Had the bank mentioned about the card closure date, the discrepancy in reporting could be easily identified.

I also mailed to crpc@rbi.org.in with my replies to bank's responses and requested them to reconsider the complaint

I didn't mention one thing - SBM Bank said that they mailed me on 09 August 2024 regarding this, but I DID NOT RECEIVE ANY COMMUNICATION FROM SBM BANK AFTER 12TH JULY.

Since the complaint is closed under non appealable clause, the complaint would not be reopened.

Now I seek the community's advice on what step can I take next to get those extra payment reportings removed?

@TechnoFino kindly advise me regarding this. I don't want to get into legal wars like sending legal notices or filing a case.

Also I have seen a similar pattern of extended reportings by Aditya Birla Finance Ltd for Paytm postpaid accounts. And for that case the RBI ombudsman called me 2-3 times to seek my view and comments on bank's responses..

Now let's start:
I had 4 Paytm postpaid accounts facilitated by Aditya Birla Finance from 2021 to 2023.
Below are the details of the accounts:

1.
Date of Last Reporting: 31-05-2024
Status: CLOSED
Close Date: 14/12/2021

2.
Date of Last Reporting: 31-05-2024
Status: CLOSED
Close Date: 08/09/2022

3.
Date of Last Reporting: 31/05/2024
Status: CLOSED
Close Date: 10/04/2023

4.
Date of Last Reporting: 31/05/2024
Status: CLOSED
Close Date: 08/09/2023

As you might understand that there Are continuous payment reporting happening in all these accounts maintained by Aditya Birla Finance Ltd.

This is just one screenshot from the experian report. Similar reporting is noticed in other 3 accounts and in CIBIL report as well.


This is not just with me: @RaunakPrasad_26 also had noticed this same kind of payment reporting from Aditya Birla Finance Ltd. View attachment 64684

This kinda situation is not visible in any other bank credit card account or personal loan accounts. Only Aditya Birla Finance Ltd has done this kind of reporting.

Also it's not like there are different rules for ABFL, have a look at below image View attachment 64686
In the above image you can see a similar category of account just different lender. The account was opened and closed in same year and last payment is also correctly reported. This is how it should be.


I have raised this issue with Aditya Birla Finance Ltd on 20 May 2024. ABFL didn't resolve it at all even made new payment reporting after the complaint as well.
So escalated the complaint with RBI ombudsman on 30 June 2024.
Got a call from them to share latest credit report again. I shared that on 09 July 2024.
Till now there is no update on this issue.

I request everyone to recheck their Experian credit report for this similar issue by ABFL Paytm postpaid accounts.

You can raise a new complaint by selecting the option something like - "complaint not dealt with". In the description, mention to your previous Ombudsman complaint, but modify the wording slightly this time. Highlight that the bank provided incorrect information to the RBI Ombudsman (RBIO), attach proof of this, and mention the dates clearly in the description of the complaint. Also, mention that the RBIO did not verify the information and failed to follow the RBI's established framework. Request compensation of ₹100 per day, based on the following:

As per RBI's circular (RBI/2023-24/72) dated October 26, 2023, CICs and CIs are required to resolve credit disputes within 30 days (21 days for CIs and 9 days for CICs). Failure to do so entitles you to ₹100 compensation per day of delay, which must be credited to the provided account.

I have the same issue with Standard Chartered. I closed my card in 2020 but they are still reporting 0 due till last month. I had emailed them last year but they did not update Cibil. I again emailed them last month and they replied that they have taken action, but when I checked Cibil, they still updated 0 due for Aug. I also started receiving credit card billing sms saying my monthly bill is 0 since July 2024. Dunno what the have done to reactivate my account.!

I was thinking of taking this up with RBI, but after seeing this, I am sure standard chartered will follow the same tactic.

Is legal action the only way out in such cases??

Depends on the ombudsman assigned for your case.
The ombudsman assigned to my case was shitty person, and i can say this to his face.

@Riva you do have a strong case. File with RBI. If you get a good ombudsman assigned then definitely your case will be resolved.
Also mention the first complaint date of last year in RBI CMS. Basis that you will be getting more than 30k in compensation itself.
