There's no point discussing here. Get a CA and discuss this matter. And definitely file ITR for this year. Let us know whatever outcome comes. As per CA fee, it should not be that high, it should be around 5-10k. I can get you connected with CA if you don't find one.

In that case your brother used that money for business purpose or other purpose and then return it back

That depends how you show it in records like a loan to your brother by You or some other Accounting treatment.

Mera last 2 saal minimal income tha. 4.5L ke spends the cards pe. Sab pehle ke savings se hi pay kiye the. Koi ITR nhi file kiya tha na hi koi notice aaya tha.
