Technically it's a violation of the MITC, and illegal as well. One need to be very careful even before thinking of doing this.
 
@NAB can you throw some light on why this is illegal? Don't you resell your phone?
Or if you ever ordered a non-returnable product from Amazon, would you not pass that to someone for money? Or will you consider it to be illegal? Seems to be like the choice of the word 'illegal' is lil too harsh.

Anyway, I am not providing reference to any such booking agents, I have just mentioned a market where one can find such dealers, and I don't think it violates anything 🙂
 
If someone is interested in earning extra from CC (apart from the regular rewards)

Basically, you will find a lot of dealers in Karol Bagh, Delhi. They will pay you around ~3 to 5% extra on the buy price.
It's an easy way to earn 30-40k extra per month + regular rewards, especially if you have multiple credit cards. [depends a lot on ongoing sale/offers on amazon & fk]

If you are able to find such a dealer offline then it's a good deal if you see the overall gain along multiple years.

As per the TnC of the Flipkart, Amazon, etc. These purchases are for your personal consumption only. Not for resell. (Just refer to the invoice as well.)

MITC means Most Important Terms and Conditions for the Credit Card usage. It prohibit you from such activities. (CC is for personal expenses.)

Illegal is not a harsh word bro. This process is a criminal offense actually. 😅 (yeah, that's what they book you for once got caught)

For Genuine reasons, you can argue that you can sell your stuff. But, no one purchases a new phone every month and sell it again and again. You can't justify that. (Phone is just an example here.)

And during this process, someone may start over spending on CC than their actual income, and receives a love letter from IT department.

You might be doing this for years, but why to live in a fear of getting caught one day? Live worry free!

Is there any rule to define what constitutes a "genuine reason"? For instance, is this addressed in the Constitution of India or Flipkart's terms and conditions?

For context, the offense of selling a device once with a "genuine reason" versus booking multiple devices is considered the same. Additionally, since you aren't physically holding the phone (the dealer does), it involves their risk. This situation is quite similar to ordering a phone for a friend using your credit card; the friend's actions are their responsibility, and you merely have a transaction to retrieve the funds from their bank account.

Perhaps you should study the law before labelling something as a criminal offence. I have studied law and can confirm that there is no specific section of the Indian Penal Code that deems this illegal. There is a distinction between what is illegal and what is ethically wrong.
Please don't get back with some vague section of IPC that might broadly cover this, as it will again start the same argument.
