Seeking Information & Support: Compensation for Wrongful Account Freezing and Mental Harassment

DimeEarner

TF Buzz
Hello everyone,
I am writing to seek guidance regarding compensation for the severe mental harassment, reputational damage, and misconduct I have faced due to a wrongful debit freeze and lien on my savings account.

Summary of the Issue:
  • On 1 July 2024, my savings bank account was debit frozen and lien marked due to a false cybercrime complaint.
  • This complaint was filed by a bank where a PPI wallet issuer holds its escrow account. The disputed transaction, flagged as fraud, was not even credited to my account—a fact confirmed in writing by both the PPI issuer and the concerned police officer.
  • The complaint was wrongly registered on NCRP (16 June 2024), yet my bank acted without verifying facts and froze my account.
  • When I visited my branch on 6 July 2024, I was insulted and humiliated by the branch official for no reason—he behaved as if he had personal animosity against me.
  • After RNO escalation The bank claimed on 15 July 2024 they received a notice from a Law Enforcement Agency (LEA) but refused to provide me a copy and asked me for NOC and emphasis on that after NOC my account can only be unfreezed.
  • After contacting multiple police officers because bank not even provided me the contact number of police only email and in india police not reply emails, I finally contacted that police officer whom that fraud compliant was assigned and found out that no such freeze/lien notice was ever issued to my bank by them even later after IG and deputy commissioner intervention i found no such notice ever issued to my bank for freeze or Lein.
  • I escalated the issue to RBI via CMS, and while the freeze was removed, the lien is still not lifted, and RBI closed my compliant under non appealable clause stating no compliant for deficiency in service because the RE did in compliance with LEA order/notice.
  • Then I compliant against that PPI issue at RBI but it again assigned to my bank and this time they shared a printout with RBI but RBI again closed my compliant giving previous compliant refrence decision already given on this subject matter however i found that print out which bank claimed a notice and in this print out the response of that bank which wrongly reported my account and my bank responses only these two comments were mentioned but no where it was mentioned that either freeze or Lien the account and surprisingly in this printout i found my bank responded after my branch visit where my account is freezed on 1 July and my bank updated their comment on 6 July in the evening 😂.
  • After this print out i bombarded email and social media posts to that bank but they ignored it then tagged their CEO and finally that bank talked with police and police issued written confirmation stating reported fraud transaction is not credited to my account it is credited to other customer of that PPI wallet so remove the lien from account after reviewing the correct money trial on NCRP which is updated not despite the police clearly instructing the bank to do so my bank not removed lien yet.
  • The police officer sent another email to my bank this time I was in cc and it delivered but my bank claimed no email recieved from LEA which is police where clearly police confirming that the fraudulent amount was not linked to my account. Yet, my bank falsely claims they never received this email (which I have verified was delivered correctly) because I am in cc of this email.

Current Status:

  • My complaints are still under RBI review:
    • One against my bank for staff misconduct.
    • Another against the bank that made the false report, which later admitted they only updated beneficiary details and never asked to freeze or lien mark my account.

Evidence I Hold:
  • Written confirmation from the PPI wallet issuer that my account was wrongly flagged and reported transaction not credited in my account.
  • Written confirmation from the police that no fraud occurred on my account.
  • Email proof (CC’d to me) from police to my bank requesting removal of the lien.
  • RBI responses, bank responses, and all complaint acknowledgements.

My Questions:

  1. Given the mental agony, reputational damage (being tagged a fraudster), bank staff misbehavior, and continued failure to lift the lien despite police clearance, what level of compensation am I eligible for under RBI guidelines?
  2. And what can I do now please help?
  3. Has anyone faced similar issues? What steps helped you get relief and justice?

This issue not only disrupted my finances but also affected my sleeping cycle and mental peace. I am not seeking revenge—only justice, transparency, and rightful compensation.

Would deeply appreciate insights, advice, or any relevant references.

complaint on cpgrams portal, ingram portal with all the details.
Already done INGRAM this is the worst platform banks response anything and compliants get closed
and at PMO the bank responded same but I appealed and it passed around 20 days nothing happened still under process

If you are expecting something phenomenal out of your RBIO complaint, then you are most probably due for disappointment.
RBIO does provide compensation in few cases but what you would achieve via a lawsuit, cannot be achieved via a RBIO complaint.

If you assume that the folks sitting in RBIO office posses the skills of top-notch regulatory professionals, then you would be disappointed to know that most of them can't even completely comprehend the content of the complaints. After filing more than half a dozen of RBIO complaints and getting compensation in some of them, I still say this that most of the RBIO staff's IQ is equivalent to a kabootar. They just pass messages between complainant and RE, and when it comes to decision making or logical reasoning about the complaint, then if you are lucky and got assigned a smart RBIO staff, you would gain something out of your complaint. Otherwise, you are in for a disappointment.

I'm not saying that do not pursue RBIO complaint, pursue it. Good that you have already filed the RBIO complaint, because if you file a lawsuit, then chances are dim that RBIO will entertain your complaint on the same matter.

In this case, all this started from a police complaint i.e. a subsidiary of the legal system, it should end at another subsidiary of the legal system i.e. court of law.

As others have also suggested, and that suggestion is actually the right thing to do in this matter: Get a good lawer who is expert in financial fraud and banking matters, disucss with him about all the evidence that you have (and the format and procedure to make these admissible in court) and file a lawsuit against the bank.

You could ask for justice, transparency, and rightful compensation in that lawsuit.

Thanks @Quantum I am in direct contact with ombudsman he is also discussing with previous ombudsmans who closed my compliants and in second compliant he asked clarification from my bank. Thats why I posted my compliant here for guidance on compensation how can I ask and how much can I get

If this again met with disappointment then definitely seek court of law

But this time I have more strong evidences where it is clearly shown bank is doing this intentionally and deliberately also they mocked RBI too which is disrespectful for the regulators which called banks of bank also i discussed this issue with consumer protection cell of ahemdabad and after listening my issues he said prima facie bank ki galti lagti hai but usne RBIO pe depend krne bola aur ye bhi bola agr ombudsman phir se close krta hai compliant to mai inko mail kr sakta hu

Is liye mai compensation ka puch rha tha koi document circular etc which can support my case at RBI then It will more helpful for me

Aur han ye dono complaint pichle 2 mahine se pending hai abhi tk close nhi hui hain

Phle ki complaints to 20-30 din me hi close ho gyi thi even 2 complaint to within a week

If you can share, how much amount they freezed and how much is in lien ?
How old your account is ?

also they mocked RBI too which is disrespectful for the regulators which called banks of bank
This is normal for banks to do if you are not aware. For most of the RBIO complaints, banks try to deceive RBIO staff by cleverly deviating from what is being asked or questioned and saying something as they did some favor to you or you are the one who is wrong. And most of the time, RBIO staff buys that and closes the complaint in bank's favor.

If compensation is what you are looking for, then I hope you have mentioned the compensation amount (Max limit 1 lakh, in the text box) for mental harassment and anguish while filing the RBIO complaint.
Another compensation option mentioned in the RBIO complaint is compensation asked for the disputed amount. This is provided based on the actual monetary loss that has occurred or gain that could have happened.
I hope you have mentioned compensation amount in these fields in your complaint.

Is liye mai compensation ka puch rha tha koi document circular etc which can support my case at RBI then It will more helpful for me
RBIO scheme doesn't talk about compensation in detail nor the specifics of it. There is no such table maintained publicly that for such and such case, provide this much compensation. It is up to the discretion of the RBIO staff based on the internal references that they maintain and refer to.
Aur han ye dono complaint pichle 2 mahine se pending hai abhi tk close nhi hui hain

Phle ki complaints to 20-30 din me hi close ho gyi thi even 2 complaint to within a week
My first RBIO complaint, in which I got the resolution but no compensation went on for 4 months.
My second RBIO complaint, in which I got the resolution and the compensation went on for 3 months.
3rd, 4th, and so on got closed in 1-1.5 months.

Some RBIO complaints do take time. Banks ask for time from RBIO staff to investigate and revert.

I could understand that you might only be looking for compensation and nothing much, and pursuing a lawsuit could be both time taking and an expenditure. But if you ask us, we would suggest to pursue a lawsuit irrespective of the decision of the RBIO complaint. This is completely up to you to pursue it or not.

Please don't get us wrong. Nobody is telling you that don't pursue RBIO.
All we are saying is that pursue RBIO but also pursue lawsuit for better outcomes.

RBIO does have much power, but great power demands great skills and expertise to utilize that power.
All of us are open to help you out on your RBIO complaints, so do ask anything on that matter here. It's just that a lawsuit will teach bank a lesson.

Most of the banks just put a freeze on accounts these days as soon as they get a complaint. All it could take a credit from a fraudster's account even though it is 2-3 layers up. And we are getting to know about some of the cases via this forum or forums similar to this one.

Just think about those fellow citizens who aren't technologically aware, don't know how to raise their concern or complaint, who can't share their concerns in a forum like TF, and have to go to banks every now and then just to get an account unfreeze.
For some fellow citizens, the amount they kept in that account could be everything. Maybe some important event of their life depends on that amount.
It's a situation of panic and helplessness for them.

There should be a mechanism in place that protects the interest of both the parties: the party who is the victim of financial fraud, and the party who is in the perimeter of the fraud but neither a victim nor the culprit. As the first step, what they could do is to just freeze the amount in question based on the severity of the fraud, instead of the whole amount/account.
But all of this requires direction from ministry, guidance and governance by RBI, and implementation by financial institutions.

And that's why a court of law would decide the case based on its merit and existing laws and their boundaries.

No i am not getting you guys wrong i became much educated from this website and DD

This post moto is help and awareness how banks are harrasing and misleading RBI

I need guidance on how to tell ombudsman about it by giving references to the RBI guidelines which i think are being violated i tried searching on web but not found or maybe not understand

So I need relevant clause circulars etc so that after exhausting everything when I reach court then I have grounds how the system is being misused and what that bank did in my case

Actually for staff misbehaviour bank replied to ombudsman that i haven't provided proofs of misbehave ab in chaman chutiyon ko kon samjhaye ki koi bhi insaan bank video aur audio recordings start kr ke nahi jata aur jb person already distress me ho jahan uska bhut high amount freeze kiya gya ho ombudsman ko khud samajhna cahiye yaar km se kam PMO ki complaint me bank ne acknowledge Kiya but ombudsman ko mislead

Aur dusri bank ko to pta tha na escrow account me PPI issuer ke genuine customer ke bhi transactions ho sakte hai

Galti to clearly visible hai usi me guidence cahiye ki aur kese frame kru jisse dono bankon ko phaas saku halanki mene ombudsman ko call be already chillaya tha kya kr rhe ho aap log bank bewakoof bana dete hai kuch bhi reply daal ke aur complaint bina padhe hi close kr dete ho kya to bola tha ki previous compliant ka refrence daal diya tha aapne to muzhe laga ki same hi complaint hai usi ne phir bola dobara complaint kro delhte hain kya kr sakte hai
