Hello, I have placed a order on Swiggy on 30th June 2024 and made the payment via my HDFC bank credit card, UPI, then. But the payment failed and that's why the delivery man asked me to pay to his UPI ID, which I paid through bank account as it was his personal account. And the payment succeeded and he delivered me the order. Now the twist starts. Swiggy initially told me that after 2-3 business days, even after a month long when I didn't get the refund and they keep on telling me you would get the refund, you would get the refund. I raised the Chargeback request with the HDFC. They, at that time, provisionally had provided me the refund. I thought the case was over. I didn't pay it. But then today HDFC has said that they have enquired with the merchant's bank and they said they have provided me the services and so they have reversed the refund. Now I want to sue this via consumer court as well as RBI of not giving refund on time. What all things can I do? Because it's not a bank in the first place, so I don't know whether I can apply the T-5 rule of RBI.
