Income tax notice for credit card spends..

Going by the strict language of the law, any expense transaction with related parties u/s 40A(2B) will have to be reported in clause 23 of form 3CA 3CD.
@CA Karan Agarwal What in the case I pay all the bills for myself and my parents and then they transfer some money to me via bank, will this also raise IT notice?

All are legit bills but my spending is less while home expenses are more and I'm filling them using my card

If you have all the proofs for your expenses, then there's no need to worry. Simply share all the proofs when they send you a notice.

Acceptable. However just try to keep the accounts separate as much as possible.
Money transfers between family members will have to be shown as either loan or gift or reimbursement of expense.

Unfortunately most of the people don't maintain accounts hence don't consider this important..

They will first send compliance notice. You can reply within compliance portal. If they are satisfied, there won’t be further interactions. If they are not satisfied, next steps might involve visits to meet AO.

What do you mean by keeping accounts seperate? Can you please explain it a bit ?
 
Hi just a query what would happen if my annual income is 13la and my annual credit card spending on all cards exceed 24la and spending increase 10la on a card. The high spending on my credit cards is due to paying my credit card bill through another credit card via the UPI loophole. Pls let me know if i will have issues with income tax department.

AIS me kya aur kitna report hua hai. Focus on how to give explanation for that only. Have you received any compliance portal notice?

I haven't received any notice till date. AIS is reporting all the transaction. I have used the UPI loophole to pay one credit card from another

If AIS reports it then focus on it.
Secondly if you receive a inquiry you should be able to account for the money saying that you paid bill of one card using another for which you would have paid charges
This should suffice.
If there are spends done at merchants or POS with this income to spends ratio that is when an enquiry is raised

i generally dont prefer transfers of big amount between family members. and keep the accounts separate as much as possible. like i said, fund transfers between family members needs to be shown as either a loan or gift or income. If not an income but will have to be justified to IT officer in case of scrutiny.

Eg. Salaried people take HRA deduction by giving rent to family member but family member not showing it as income in own ITR is not correct.

Like i say if anything can be justified with paper trails then there is no issue. so if you want to avoid all these hassles, avoid or minimize all these things.
