SBI Card, Rejecting to file a chargeback

So basically i bought a dishwasher on flipkart. After a few days, the dishwasher stopped cleaning the dishes. Contacted lloyd for support, after 3 services, the problem still exists, and despite multiple emails Lloyd went silent.

I approached SBI card to file a chargeback since the merchant claimed a 1 year warranty on the product and they are now not helping.

Sbi card PNO after multiple emails is rejecting to file a dispute, stating the transaction is settled with the merchant. Despite it being only 60 days of purchase. And the timeline for dispute for SBI cards in 90 days.

what can i do here?

help is appreciated.

First raise complaint in consumer forum stating the deficiency in service by llyod and ask for refund!

Further on raising grievance on consumer portal, if llyod still become deficient in providing services.

Then attach this complaint screenshot of consumer forum again with sbi pno which will act as a proof for raising the chargeback.

If again sbi declines to raise chargeback ( although u have provided them valid proof) then on this ground ,now raise complaint with RBI OMBUDSMAN, they must help you in refund!

The PNO still didn't want to raise a chargeback despite valid proofs stating the system is not allowing her to and gave a written confirmation for the same.

As a last beam of hope i sent a mail to just chargeback@sbicard.com and the Dispute was raised within 30 minutes of mail.

Looks like a lot of SBI Card's PNOs give bogus responses without proper research.

Anyways, my issue is resolved. Thanks to all who helped.

How chargebacks work is that the bank will raise a chargeback request with the merchant, in this case, Flipkart.

Flipkart will respond to the bank with proper proof that the payment was for a dishwasher order which was received and verified through open box delivery and OTP, so they cannot issue a refund.

Flipkart is not responsible for any issues you'll face with the brand.

Actually flipkart on their product listing claimed it can intensively clean dirty kadhai.

I shot a video, as it doesn't really does that even after 3 services. So what flipkart claimed on their listing was incorrect.

Flipkart is not responsible for any claims made by the company on the product listing.

So in your case, a chargeback won't help. You have to raise a complaint on the consumer forum against Lloyd & ask a refund as mentioned by @pinki

If you are a shopkeeper and you sold a pack of Maggi, and after a few days, a customer came back asking for a refund because they were unable to make the Maggi in 2 minutes as mentioned on the product.

Do you think you are responsible for it?

Or imagine the customer is raising a chargeback request with their credit card company against you, mentioning these details.

May be or may be not, let's see argument pe depend karega with proofs and facts.

How they can't? Chargeback is made to safeguard customer's interests and rights, OBD doesn't guarantee the product will work as described, under OBD, a customer is supposed to check for damages, wrong product or missing items, only.

Quality/Function of the product as per the description will only get revealed when it will come in use. This is called latent or hidden defects, if it doesn't work as it's supposed to, customer can't check this hidden defects before accepting delivery with an ordinary diligence. Customer is not at fault at all.

The product must matches with the description. If it's advertised or listed that the product will be able to clean the dirty utensils, it must clean because OP was induced to purchase by this only, in other words, it's condition but not warranty as to enter into the contract. He has solid ground to use his right; right to repudiate the contract and ask for refund, either by filing chargeback which is provided by Card's Network or by filing case/ complaint against the merchant along with Flipkart.

Flipkart will be accountable for such fraud as well because it's at fault on his part as well. You can check several times ecoms was made liable and asked to provide compensation to customers from different courts and redressal department in past.

That's only when Flipkart gave wrong item or damaged item to the customer.

Yes it's not a fault of customer. It's a fault of brand that is Lloyd.

Do you expect Flipkart employees to visit each and every seller and check all the products, including his dishwasher with a dirty kadhai, to see if it can clean it?

Agar sabke liye Flipkart responsible hai to mujhe bhi chahiye paise. Moto phone me 2 saal ka update promise kiya tha nahi aaya. Mai bhi chargeback raise karun😂

Refund milne ke baad phone ko sell kardunga.

You're making a different analogy. If I am not responsible, I will ask the refund will the wholesaler/dealer/
manufacturer, from which I have purchased, by sharing the incidents and ground, raised with the end customer.

So what should customer do? If he has purchased some product, and it is found as defective or not as per the description and then the customer should let go his hard earned money due to the fraud of manufacturer?

If customer has purchased from the retailer only why he will ask the refund from manufacturer? It's obvious refund will asked from the seller only. Because the contract is made between buyer and seller (retailer). I am not saying retailer is totally at fault. Ultimately it's manufacturer only. But somehow retailer being buyer is supposed to check the sample pcs when some product gets launched or marketed before making the actual purchase. Not anything can be purchased and sell and later on I haven't done anything wrong, I am raising my hand, I am aggrieved party but not customer can't be said.

There's is chain, this gets followed from upward to download to deliver the product to the customer. Likewise, now it's time for downward to upward moment.
