Yes it's who denied from this fact. But Flipkart should co-operate with the customer and bear the refund or loss and later on Flipkart can ask with the Lloyd. Flipkart being an intrested artificial person can pay and later on ask from the faulter; Lloyd.
There's contract between Flipkart and Lloyd as well.
I don't expect anything, laws expect it. I don't like to argue further with the same reasoning again and again. If you don't believe, view some past decision/ order made by commision and court in favour of customer, you will understand the liability or marketplace like Flipkart and Amazon.
Flipkart is not a small retailer; Flipkart and Amazon are dupoloy in the markets. There's deficiency in service on part of Flipkart as well. Flipkart is responsible as well. It has indulged in unfair trade practices by just listing the product and not taking care that the listed product matches with the description or not.
Flipkart or any other ecom can't raise hands by stating there's no privity of contract, I am third party being marketplace or facilitator. Parties to the contract are customer/ buyer or seller/ merchant. I have nothing to do.
But refund and compensation depends upon the nature of circumstances of the case, ground and argument as well.
