RBIO: Got compensation of Rs. 21000 from HSBC

Two step process:
1. Shift to @sjmajumder house. And update adhar and bank address to that address.
2. After filing complaint, follow the ombudsman assigned to find which hotel he goes to. Then simply do what blackmailers do in saavdhan india.

Did I miss anything @sjmajumder ?
Why to go for two step trouble
1 step process
1. Give your login credentials to @sjmajumder he'll take out the fees himself and file and fight over the case for you while you sit back and relax and watch the trolling!

Hey @sjmajumder , this is regarding a complaint my cousin raised with RBIO against a major bank (not credit card-related but mortgage loan-related). The bank has not released the property documents for over 15 months now since the final payment, despite repeated requests and complaints. He filed a complaint with RBIO recently, seeking compensation of ₹20 lakhs with a complete timeline and all documentary/email proofs. Now, the bank has suddenly started calling him, stating that they will release the documents in a few days.

My questions to @sjmajumder / other experienced members with RBIO process:
  1. Can he accept the documents (as it is a high-value property) for safety reasons at the earliest and still proceed with the compensation claim?
  2. As per the RBI circular, banks are liable to pay ₹5,000 per day, which already exceeds the ₹20 lakh claim amount. Can RBIO award such a high claim amount?
  3. Would he be better off going to consumer court in case RBIO doesn’t work?
  4. Since the bank is now calling him that they will release the documents, will there be a physical meeting or would the process be online and will the Ombudsman be part of it?
Any advice is appreciated, thanks!

What is the bank's explanation for not releasing the documents for so long? There is separate process for taking the documents back. Have you done that?

  1. Can he accept the documents (as it is a high-value property) for safety reasons at the earliest and still proceed with the compensation claim?
Yes, he can accept. There is no safety issue here. As long as it is in bank's custody, it is the bank's responsibility.
  1. As per the RBI circular, banks are liable to pay ₹5,000 per day, which already exceeds the ₹20 lakh claim amount. Can RBIO award such a high claim amount?
RBIO can award a max compensation of Rs. 1 Lakh but that is for harassment, expenses, mental anguish, etc.
If RBI circular states 5000 compensation per day, that will be additional and RBIO should be able to award that and an additional 1L too for harassment and mental anguish.
  1. Would he be better off going to consumer court in case RBIO doesn’t work?
Wait for RBIO order and then decide accordingly.

Depends on RBIO.

Thank you for the response, we'll wait for an update from RBIO.

Typically how long does the complaint with RBIO take? What was the timeline in your case?

So my RM promised me a particular card (hdfc) early Nov, which included card upgrade and limit increase. Nothing has happened since then on the upgrade front except empty promises by the RM and his boss but instead have had 3 cibil hits with a paltry limit increase. The RM promised deviation approval but is unable to do anything now. I have disputed the cibil hits and also written to hdfc including escalated to grievance redressal.

What kind of case do i have ? It's caused a lot of anguish and harassment and followup and wastage of time.

Did you get limit increase against each CIBIL hit?

Do you have written proof or voice recording of the promises made?

First cibil hit had a small limit increase, not in line with what was discussed.

Second and third were just hits no action.

I have written proof of the upgrade and limit increase, in a mix of whatsapp and emails messages.

As per the RBI notification, the “directions shall be applicable to all cases where release of original movable / immovable property documents falls due on or after December 1, 2023.”

Yes that's my next step...

I have to collate all my discussions and emails and conversations in an email to ensure i capture the whole saga!

You can go ahead and complaint to RBIO
I had raised a cibil dispute and hdfc closed it in 4 days saying complainant has given consent. I have my follow up email and Whatsapp messages to the RM high lighting the unnecessary hits.

Should I write to pno first then RBIO - do i need to dispute in cibil again or let it be?

You have done once. That's more than enough, unless you want to delay
