Sorry for late update...

HSBC mailed in response to RBIO complaint and credited Rs. 1000 to my card on 12-Sep. In the response mail they tried to hide their incompetence and stated card has been delivered, however due to the delay they are paying a compensation of Rs. 1000 as a goodwill gesture. I replied stating please go through my complaint, all call date and time are given in my mail. Take out the call recording and see how you have harassed me for over 2 months.

There is no update to RBIO complaint as of yet.



No update on Axis complaint yet.

Received WhatsApp message from branch requesting for a call. Yet to receive the call but received mail from RBIO for a meeting on 11-Nov.

i took a bank of Maharashtra home loan and the processing fees told by the bank was 40k total including all but now the bank has deducted almost 85k as charges towards loan and I’ve complained this to bank no response complained to rbi but they said that they can’t intervene for 30 days from the case is registered with bank 3 November 30 days will pass and how to reach to rbi? And also the bank manager deducted this whole charges from the loan account without my consent how to complain about it and can anyone help me with the current situation

Hello everybody

One of my first credit card - OneCard by SBM Bank India.
Issued - 5 Sep 2022
Closed - 8 Sep 2023
Last Credit reporting to CIBIL & Experian - May 2024

Just with above information, any stupid person will also understand that the bank is reporting my payments even after closure of card.

Bank has reported Zero DPD which is technically correct but this increased the payment history from 12 months to 21 months.

Now here's the story begins
I noticed these in May 2024, first complained to SBM nodal officer on 09 June 2024..
Did not receive any response from them. Escalated to principal nodal officer then also didn't receive any response.

Then had to complain to RBI ombudsman on June 27. On Tuesday this week I received the closure mail from RBI stating the summary of what SBM Bank responded to the complaint -

My major concern is that rbi ombudsman didn't gave me a chance to counter the bank's response. The bank has clearly hidden the card closure date, that's why last reporting in May 2024 seems justified.
Had the bank mentioned about the card closure date, the discrepancy in reporting could be easily identified.

I also mailed to crpc@rbi.org.in with my replies to bank's responses and requested them to reconsider the complaint

I didn't mention one thing - SBM Bank said that they mailed me on 09 August 2024 regarding this, but I DID NOT RECEIVE ANY COMMUNICATION FROM SBM BANK AFTER 12TH JULY.

Since the complaint is closed under non appealable clause, the complaint would not be reopened.

Now I seek the community's advice on what step can I take next to get those extra payment reportings removed?

Yes, it happened for the previous HSBC case where HSBC did not attend the meeting and I got Rs. 5000 compensation.

Do you have it in writing that processing fees is 40K? I believe it depends on the loan amount and same should be mentioned in the agreement that you have signed. First get the proof, then take action accordingly.

Just received a call from Axis Bank. They have requested me to consider a compensation of 20,000 instead of 50,000 which I have demanded in my complaint to RBIO. She requested me saying it goes against employees and she and her colleagues will land in problem if the amount is greater than 20,000. It appears she can settle 20K with branch level approval and for anything beyond that it goes to higher authorities, which she is trying to avoid.

Does it mean RBIO is going to give the full demanded compensation, or are they just scared? Meeting is scheduled on 11th November.

Opinions please.

Would love to share my opinion. But sadly I am not aware about the facts relating to the complaint made against Axis. 🙂 With the availability of the facts of the case, I can put informed & well founded opinion.

Kindly share the summary of the facts, I tried finding it but couldn't able to find it neither on the first post not on the last 2 pages.

Registered 5 complaints with RBI Ombudsman demanding compensation in each. Let's see how it goes 🙂

1. HSBC - Did not convert Amazon EMI purchase to EMI in a timely manner and sent full amount statement. After paying full amount they converted to EMI and charged interest. Also created lot of hassles in refunding credit balance after converting to EMI.

2. IndusInd - Doorstep Banking delayed cash pickup. Took 3 follow ups and one complaint to finally get the cash picked up after a five days delay.

3. Federal Bank - Issued Visa Signet when I applied for Celesta MC. Registered a complaint of mis-selling.

4. ICICI - Sapphiro Amex Addon card not working.

5. ICICI - 2 CIBIL enquiries for one Sapphiro application under alumni program.

15-May-2024:
It seems the 30 days rule is there and bank can ask for it. 1 and 2 closed based on request from bank asking for more time to resolve the issue. It is mentioned that I can lodge a fresh complaint after 30 days has passed in case I don't receive a response/satisfactory resolution.
29-May-2024: Registered fresh complaint for 1 and 2 which was closed earlier.
13-Jun-2024: #3 closed as Federal bank issued Celesta Mastercard. No compensation. Details here.
16-Jun-2024: #5 closed. ICICI removed duplicate CIBIL hit. No compensation. Details here.
19-Jun-2024: #2. Received call from IndusInd Bank complaints department. They informed as per bank policy they have credited Rs. 2000 to my account yesterday and is also sending me an apology letter. Guess next step is closure mail from RBI.
21-Jun-2024: #1. Received mail from RBIO to attend conciliation meeting with HSBC on 26th June at RBI Kolkata. Details here.
24-Jun-2024: #4. Disappointed with RBIO. Closed complaint based on one sided input from ICICI stating no transactions were declined and they showed latest statement where there is transaction in primary card and RBIO got convinced and closed case. No option to appeal either. Written to RBIO, no response. Called them and I was told to go to court. This is VERY DISAPPOINTING.

05-Jul-2024: #1 Received mail from HSBC PNO to share account details for credit of Rs. 5000 as per BO order.

Summary:
All cases closed.
#1: Got compensation of Rs. 5000
#2: Got compensation of Rs. 2000
#3: Federal bank issued Celesta MC. No compensation.
#4: Unresolved - Case closed based on fake evidence provided by ICICI bank. No option to appeal/reopen/register new complaint. Only option is to go to consumer court. No compensation. (Update: Issue resolved.)
#5: Both enquiries removed. No compensation.
Recently I raised one compliant against AXIS. Soon, Next week I'm going to raise many complaints against BOB.
Can you please let me know how to check all the complaint Status?

Without knowing the whole story, from just the above text, i can summise that - you have already started this journey, ab koi bhai-chara or bahen-chara dekhna thik nahi. Its your issue, you are the victim here, emotional reverse blackmail se bacho.

In your last email, you quoted an amount of ₹10,000 for all the inconveniences, including financial loss, harassment, and mental agony.

However, you quoted ₹50,000 when filing a complaint with the BO of RBI. As you are aware, the RBI BO often favors banks and award compensation at its own discretion, rarely match with the complainant's demand, especially when the amount is small and is payable by the concerned bank. It's half of the max. compensation which can be claimed while making a complaint to BO, so, in other words, it's a material amount.

In my opinion, it might be more efficient to avoid further delays and efforts by making a final negotiation. If you're willing to negotiate then only, you can think to propose a settlement of ₹25,000 or ₹30,000, choose what you feel upon they agree based on phone call, tone of sound and all that instead of ₹20,000.

Note that ₹20,000 is still a significant amount. If you think to negotiate on number greater than 20k and they may reject or may some other ways to settle on a less amount be it hook or crook.

You should request that the amount be credited immediately, and only then will you withdraw your complaint.

I think a general executive cannot block a card citing multiple customer IDs on his own. This seems to be the modus operandi of Axis bank, using a lame excuse to minimize the payout through social engineering.

Since you have not claimed the full ₹50,000 compensation, where there's no substantial part, for the direct loss caused by the blocking of the card due to their own fault, this settlement seems reasonable to me.

Rest, if you take risk, either you will make more money which requires further time and effort. Or else, you will be awarded less than this, all depends upon the discretion upon BO, can't comment on it, better you know more about the BO of your region as you had face to face conversation. You decide what is more suitable to you.

I accepted their offer and got email confirmation that 20K will be paid within 5 working days 🙂
